Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Aicre websites and services (the “Service”). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization; “you” also refers to that organization.
1. The Service
Aicre provides a map-first CRE workspace with property search, AI parcel scoring, and CRM deal tracking. Aicre may update or modify features from time to time. Certain features may be labeled “beta,” “labs,” or similar and are provided for evaluation only.
2. Accounts & Organizations
You must provide accurate registration information and keep credentials confidential. If you sign up under an organization (a tenant), your account is administered by that organization and subject to its policies. You are responsible for all activities under your account.
3. Customer Data
“Customer Data” means data you or your organization submits to the Service (e.g., parcel overlays, notes, tags, contacts, skip-trace data, pipeline status, attachments) and resulting outputs configured for your tenant (e.g., parcel scores). You retain ownership of Customer Data. You grant Aicre a non-exclusive license to process Customer Data to provide the Service, support, security, and product improvement (including using de-identified/ aggregated data). You are responsible for obtaining all permissions for Customer Data and for complying with applicable laws (e.g., outreach/telemarketing, privacy).
4. Acceptable Use
- No unlawful, infringing, or harmful activity; do not attempt to breach, probe, or disrupt the Service.
- Do not upload malicious code, or reverse engineer or bypass security or rate limits.
- Respect privacy and communications laws when using contacts/skip-trace data (e.g., FCRA, TCPA, CAN-SPAM, state Do-Not-Call lists). You are solely responsible for outreach compliance and honoring opt-outs.
- Third-party maps/data are subject to their licenses (e.g., tile usage limits and required attribution such as “© OpenStreetMap contributors”). You must not remove required notices.
5. Aicre IP
Aicre owns all rights, title, and interest in the Service, including software, designs, and content (excluding Customer Data). We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription in accordance with these Terms.
6. Third-Party Services & Data
The Service may interoperate with third-party services or include third-party data. Aicre is not responsible for those services/data and makes no warranties about their accuracy or availability. Your use may be subject to additional third-party terms.
7. AI & Recommendations
AI features may generate scores or suggestions that are probabilistic and may be inaccurate. They are provided for informational purposes only and do not constitute investment, legal, or environmental advice. You remain responsible for due diligence and for decisions based on outputs.
8. Fees & Payment
If you purchase paid access, you agree to pay the applicable fees, taxes, and charges in accordance with the order or plan presented to you. Unless stated otherwise, fees are non-refundable. Late payments may result in suspension or termination of access.
9. Term; Termination
These Terms apply while you access the Service. Either party may terminate for material breach not cured within 30 days’ notice. Upon termination, your access ends and we will delete or return Customer Data according to our Privacy Policy and any data processing agreements, subject to backup retention and legal holds.
10. Warranties; Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, accurate, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, Aicre and its suppliers will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenues, data, or goodwill. Our total liability for all claims in the aggregate will not exceed the amounts you paid for the Service in the 12 months preceding the event giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless Aicre from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, Customer Data, or violation of these Terms or applicable law (including outreach/privacy laws).
13. Confidentiality
Each party may receive non-public information from the other that is marked or reasonably considered confidential. The receiving party will protect such information and use it only to perform under these Terms.
14. Changes to the Terms
We may update these Terms from time to time. We will post the updated Terms and update the “Last updated” date. Your continued use after changes become effective constitutes acceptance.
15. Governing Law; Venue
These Terms are governed by the laws of [choose: the State of Delaware / your state], excluding conflict of laws rules. The exclusive venue for disputes is the state or federal courts located in [City, State], and you consent to personal jurisdiction there.
16. Miscellaneous
- These Terms constitute the entire agreement regarding the Service.
- If any provision is unenforceable, the remainder stays in effect.
- You may not assign these Terms without our consent; we may assign in connection with a corporate transaction.
- Notices may be sent to the email on your account or posted in-app.
